Article 2 : Applicability and application of the general terms and conditions of sale
The general conditions presented here apply to all purchases made from VIGNOBLES ARCONIAN in its online shop via the website www.canonchaigneau.com. To find out the conditions of their order, the customer can click at any time, even before placing an order, on "General Terms and Conditions of Sale".
The fact of placing an order implies the full and unrestricted acceptance by the VIGNOBLES ARCONIAN customer of the various clauses presented in these GTC. Only a written agreement stipulating special conditions between the two parties can be accepted, without which these conditions thus presented are subject by right in the existing contractual relationship between the customer and the company VIGNOBLES ARCONIAN.
The offers presented by VIGNOBLES ARCONIAN are reserved for private customers and legal entities such as companies, groups and wine merchants under certain conditions.
The customer declares before validating his order to have accepted these GTC and consequently to adhere to them entirely.
Article 3 : order procedure
All orders are placed on the website www.canonchaigneau.com
The customer creates a basket by choosing the number of products he/she wants. Once the selection has been made, the customer validates the basket and the payment method.
After accepting the GTC, the orders become final when they are validated by the payment of the products.
The verification department of VIGNOBLES ARCONIAN has the right to request proof of identity and domicile from the customer (K-bis extract, intra-community VAT number for legal entities) to validate the order. In the event of refusal by the customer or non-compliance of the documents, VIGNOBLES ARCONIAN may refuse and cancel the order. On its part, if the customer does not want to submit to this control, it may cancel the order.
The verification service is also entitled to cancel certain orders if it considers that the latter presents various anomalies and irregularities (doubts about the identity of the customer, usurpation, creation of irregular accounts etc...).
At the customer's request, an invoice may be sent to the customer by e-mail or to the customer's billing address. An order confirmation is sent by e-mail.
In accordance with the terms of Law No. 80 336 of 1 May 1980, relating to the reservation of ownership, the products remain the property of VIGNOBLES ARCONIAN until full payment of invoices.
The customer becomes the owner and responsible for the items upon delivery, the transfer of possession being equivalent to the transfer of risk.
Article 4 : Procedure of Payment
The payment of the products can be done by Paypal and bank cards.
Credit cards: cards with the CB, VISA, EUROCARD, MASTERCARD or AMERICAN EXPRESS symbol are accepted.
Article 5 : Prices
For France, the prices are expressed in Euros (€) and displayed including all taxes (French VAT and all other applicable taxes). For the other countries of the European Union, the price differs according to the country of delivery of the product and will take into account the local VAT of the country of consumption and other taxes (excise).
The price indicated on the product sheets is indicated with transport costs included. However, there may be an extra charge for shipping to countries outside the EU Zone 1: this extra charge will be calculated when you finalise your order. The company VIGNOBLES ARCONIAN reserves the right to modify its selling prices.
All promotional operations (vouchers, discount coupons, partner discounts ...) are limited to one person per household and per operation. VIGNOBLES ARCONIAN reserves the right to refuse orders that do not meet this criterion.
Article 6 : Delivery
National delivery: Upon receipt of payment for the order, VIGNOBLES ARCONIAN will initiate transport and delivery operations. The delivery of the ordered items is made to the address given by the customer. The delivery information provided by the customer is binding. In the event of an error or lack of information resulting in a defect or absence of delivery, VIGNOBLES ARCONIAN cannot be held responsible. In the event of a return due to an incomplete address, the customer will have the option of either modifying the address and having the goods reshipped, bearing the new shipping costs, or having the order reimbursed by deducting the initial shipping costs.
Community delivery: For customers wishing to have their goods delivered to an EU country, Vignobles Arconian will take care of the delivery of the products in the same way as a national delivery.
Delivery outside of the EU: For customers wishing to be delivered to a country outside of the EU in the same way as a national or community delivery, the company VIGNOBLES ARCONIAN is responsible for the delivery of its products. Responsibility for transport: It is the customer's responsibility to check the contents of the parcel at the time of receipt and to make any reservations, if necessary, in the following way: on the delivery slip provided by the carrier or by immediately calling the carrier's customer service department, in the presence of the delivery person. And, in all cases, by notifying the company VIGNOBLES ARCONIAN within 2 days after receipt of the package by our contact form.
Deadlines: The company VIGNOBLES ARCONIAN undertakes to make every effort to deliver the products ordered as soon as possible. The deadlines vary according to the product, the delivery method chosen and the country of destination of the goods. If the products in the order have different delivery times, the longest delivery time shall apply to the entire order.
ATTENTION: IN CASE OF DAMAGE OR BREAKAGE
IMPORTANT: The carrier is responsible for the integrity of the package during delivery.
It is the customer's responsibility to check the contents of the package upon receipt and to make precise and motivated reservations stipulating the damage, if necessary, by writing them on the delivery slip or the electronic box provided by the carrier. The customer may also refuse the package if its integrity has not been preserved.
In all cases,
The customer must notify the company VIGNOBLES ARCONIAN within a maximum of 48 hours after receipt of the package by the contact form or by email marine@canonchaigneau.com
If all the above conditions are met, the company VIGNOBLES ARCONIAN undertakes to offer a reshipment, a credit note or a refund to the injured customer.
Article 7 : Stock
In the event of an out-of-stock condition of an ordered product, VIGNOBLES ARCONIAN undertakes to inform the customer as soon as possible and will offer different alternatives:
- The replacement of the out-of-stock product by the next vintage or by an equivalent or superior quality product under the same pricing conditions.
- Refund of the unavailable product(s) or of the entire order, depending on the customer's choice.
In the case of a temporary shortage, the customer will be offered the choice of waiting until the date of restocking which will be indicated to him. The customer will have the option of accepting and waiting to receive the entire order, requesting partial or full cancellation of the order.
Article 8 : Commercial Operations and Opportunities
Temporary promotional offers may be offered randomly, in addition to coupons or other promotional codes - on a time, stock, availability or quantity limit. At the end of the offer, the products are likely to change price. Therefore, the customer benefits from this offer over a period of time and once this period has expired, VIGNOBLES ARCONIAN cannot commit to offering the same advantages to the customer on another future order.
Article 9 : Right to Retraction
Conditions
You have the right to withdraw from this contract without giving any reason within fourteen days.
The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods.
To exercise this right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post or e-mail to marine@canonchaigneau.com).
In order for the withdrawal period to be observed, it is sufficient for you to send your notice of withdrawal before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, we shall refund all payments received from you, including any delivery costs, without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this contract.
We will make the refund using the same method of payment that you used for the original transaction, unless you expressly agree to a different method, in which case there will be no cost to you. We may defer the refund until we have received the goods or you have provided proof of dispatch of the goods, whichever is the earlier.
You must return the goods in person or send them to us at our registered address:

without undue delay and, in any case, at the latest fourteen days after you have informed us of your decision to withdraw from this contract. This period is deemed to have been respected if you return the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.
You are only responsible for the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods. In the event that certain products have been opened or consumed, VIGNOBLES ARCONIAN will have the right to deduct these products from the refund made to the buyer.
Article 10 : Applicable Law and Dispute Resolution
Consumer Mediation Service:
Amicable settlement of disputes between the Professional and the Consumer in accordance with Articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the Consumer Code.
In the event of an unresolved dispute between the Professional and the Consumer, the Consumer may refer the matter to the Consumer Mediator.
Before referring the matter to the Consumer Ombudsman, the consumer must have already tried to resolve his dispute directly with the Professional by means of a written complaint or have made a complaint under the terms of the contract concluded with the Professional.
Consumer mediation is an out-of-court settlement of consumer disputes.
If the conditions are met, a consumer mediation will take place according to a precise process and according to the texts in force.

Applicable law and competent jurisdiction
The present general conditions of sale are governed by French law. If one of the clauses of the present conditions proves to be null and void, this will not affect the validity or respect of the present conditions. In the event of persistent disagreement concerning these conditions and in the absence of an amicable agreement, any dispute will be referred to the competent French courts.
Time limits for reimbursement
In the event of a refund following a dispute, we undertake to refund the amount agreed with our customer service department without undue delay and no later than fourteen days from the day on which you agreed in writing to the refund with our customer service department. In the case of refunds in exchange for returned goods, we may defer the refund until we have received the goods or until you have provided proof of dispatch of the returned goods, whichever is the earlier. For refunds by credit card, please note that interbank delays may delay the actual credit to your account by a few days.
Article 11 : protection of minors
The «Code de santé publique » (public health code) specifies that the sale of alcohol to minors under 18 years of age is illegal (modified, see article 93 of the French law HPST).
When registering to the site the client must recognize his being an adult and every time he orders must tick the check box confirming his adheral to the terms and conditions and thus re-affirm that he is indeed 18 or over.

In accordance with Law No. 78-17 of January 6, 1978, relating to data, files and freedoms, you have a right to access, rectify and delete personal data concerning you and are subject to processing under the responsibility of VIGNOBLES ARCONIAN. You can exercise this right by contacting our customer service department using the contact form or by post.
In order to meet the needs of customers and ensure optimal remote service, the company VIGNOBLES ARCONIAN is required to record certain personal data (name, first name, address). This information is intended exclusively for VIGNOBLES ARCONIAN.
Payments by credit card are secured by an online payment system with SSL standards. In addition, all banking information that you provide to us, during your online purchase, are neither stored nor visible on the Internet. VIGNOBLES ARCONIAN guarantees the confidentiality of your data.
Article 13 : Abonnement
The Subscription service offers its customers the opportunity to receive an order on a regular basis (regularity determined according to the option chosen directly on our website), while benefiting from a discount, the value of which will also be determined by the option chosen.
"Subscription" refers to the contract to which the customer of VIGNOBLES ARCONIAN subscribes in order to receive products regularly.
- How the subscription works
VIGNOBLES ARCONIAN offers fixed-term contracts, by direct debit and without automatic renewal. The duration depends on the option chosen. The number and type of offers may vary: VIGNOBLES ARCONIAN reserves the right to modify these terms at any time.
Each subscription is concluded for a fixed period.
The subscription will come to an end at the end of the fixed period chosen.
The day of the order of one of the three formulas triggers the time of delivery of the next orders.

The price of the Subscription is that of the order, without additional costs, and subject to the commitment of duration according to the chosen option.
- Benefits
The customer benefits from a percentage discount on subscription orders, depending on the option chosen. VIGNOBLES ARCONIAN also reserves the right to modify the value of this percentage discount at any time.
Articles 14 : images
The photos and illustrations used on the site are non-contractual. The images and photographs are the exclusive property of VIGNOBLES ARCONIAN and are not free of rights.
